Nominet recently changed their domain dispute policy cost.
“In cases where there is no response, the complainant is given the option of obtaining a summary decision from an expert, at a cost of £200 ($395),” said a Nominet statement. The cost of a full judgment is £750 ($1,480).
“The expert will not be required to write a full decision with reasoning in these cases, but only to certify that Rights and Abusive Registration have been made out by the Complainant.” These changes intended to deal with 52 percent of cases which are not opposed. However fail to address the cost of preparing the case.
In Russia, company can spend between $500 to $100,000 to get a premium domain name. Litigation costs even more because, unlike in the West, there is no quick and inexpensive way to resolve the problem in Russia. For cases that ended in the arbitration courts, this can cost from $5,000 to $50,000.
Apple accused Cohen of being a “cybersquatter” and took him to UK registry Nominet looking for ownership of the domain name.
Cohen made use of the domain by forwarding it to a music search engine service at his CyberBritain site. Originally Apple had offered a small sum of money (about $5000) for the domain, which Cohen rejected. He then reportedly attempted to sell the domain name to Apple’s rivals Napster, but the offer was rejected.
The domain original owner, America.com had been offered a sum of $1.7 million for the domain that had been registered since the 90′. The domain was valued at $3.0 million to $7.0 million. Such litigation if exist may ended push the cost of settlement beyond the valued amount.
So based on this scenario, the domain name disputes cost will range from as minimal of $395 to the least $7.0 million. But this cost can goes as high as possible since some dispute offer as out of court settlement were not disclosed to the public.
So how much do you think, an actual domain names disputes cost will be? May be you have the answer.
